HIPAA (Health Insurance Portability and Accountability Act)
Federal law governing the privacy and security of protected health information (PHI), with administrative and technical safeguards required of covered entities and their business associates.
HIPAA's Privacy Rule and Security Rule apply to health plans, healthcare providers, and clearinghouses, plus their business associates. Employer-sponsored group health plans are covered entities; the employer itself generally is not, but receives PHI under tight conditions.
PEOs sponsoring master health plans operate as covered entities for those plans and must maintain HIPAA-compliant infrastructure for PHI handling, breach notification, and business-associate agreements.
